Tim Tomasik Speaks to CBS News About Attorney Misconduct

Recently, Tim Tomasik spoke to CBS News regarding the professional misconduct of lawyers who solicit clients in personal injury cases. In many cases, people who have been in car accidents or who have been injured in other situations receive large numbers of calls and text messages from attorneys who claim that they can help them get thousands of dollars in compensation. This is a violation of the Illinois Supreme Court's Rule of Professional Conduct 7.3, which prohibits attorneys from soliciting clients over the phone. Mr. Tomasik spoke to CBS News in his role as the President of the Chicago Bar Association, and he explained that the solicitation ban has been put in place to protect the vulnerable. He stated, "People who have been injured, whether it's in a crash, or say, in a hospital, they're overwhelmed." Attorneys who violate the rules and solicit injury victims when they are in this vulnerable state are committing a breach of ethics, and they could potentially face discipline by the Illinois Attorney Registration and Disciplinary Commission (ARDC).
